Atlanta Federal Judge J.P. Boulee struck down and blocked provisions of Georgia’s 2021 voter suppression law S.B. 202.
Today, Women Watch Afrika, et al. received victory in parts of our preliminary injunction motions in our SB 202 lawsuit against Brian Kemp, et al.
Two Big Wins:
The Judge struck down the law banning line relief, stating “line relief activities” in the polling zone at 150 feet and beyond is classified as First Amendment protected “expressive conduct.” As such, line relief at 150 feet and beyond outside of the polling place is once again now permitted without threat of prosecution. Meaning, organizations may start once again providing water and line relief to voters in lines that extend beyond 150 feet from the polling place.
The Date of Birth requirement on the absentee ballot has been struck down. It is immaterial to determining the voter’s eligibility to vote by mail (absentee). As such, this ruling prevents the state of Georgia “from rejecting absentee ballots based on any error or omission relating to the Birthdate Requirement” on absentee ballot return envelopes.
Unfortunately, we were unable to get the drop boxes to be moved back outside (as that motion was not granted), however, overall, we celebrate the wins from today’s ruling.
Our lawsuit against SB 202 continues but today voters have a win in the granted preliminary injunctions!
