Atlanta, GA– On June 24th the leaked SCOTUS decision showing the Supreme Court was poised to overturn the constitutionally protected right to abortion ensured by the nearly 50-year-old Roe v. Wade decision became a reality: SCOTUS overturned Roe v Wade in its Dobbs decision.
Roe v. Wade and the 1992 case, Planned Parenthood v. Casey, barred states from passing laws that restrict abortions before the point of fetal viability — around 24 weeks of gestation, and require that laws regulating abortion not pose an “undue burden.”
However, with Roe v Wade being overturned, now individual states would be able to restrict when and how women could terminate their pregnancies, without federal courts having a say over the legality of those rules.
As such, states will impose much tighter restrictions on abortion than ones currently in place or ban abortion all together without fear of the federal courts stepping in to overrule said violation of a woman’s fundamental right to choose. In fact, it is expected that this decision will likely result in 26 states severely restricting and, in some cases, outright banning abortion care.
