Victory for DREAMers as SCOTUS upholds DACA

June 18, 2020 by Preye Cobham, Esq.

Today was a victory in the fight for DREAMers. The U.S. Supreme Court has ruled upholding the Deferred Action for Childhood Arrivals (DACA) program for young, undocumented immigrants.  The divided court ruled that the Department of Justice Security’s action in trying to end the program that allows 650,000 young, undocumented immigrants to live and work in the United States without fear of deportation was “arbitrary and capricious” and as such unlawful.
With this 5-4 ruling the DACA program is will continue and current DACA recipients can continue to renew their permits, allowing them to work legally and without fear of deportation.  However, the ruling leaves open the possibility that the Administration could still end DACA in the future if they give a proper justification.

Women Watch Afrika congratulates DREAMers on this win and notes that the fight and struggle continues. We expect further challenges of this program and all immigration related programs. Congressional legislation is the only way to provide permanent protection. But for today, victory is on the right side.
